Terms of Use

These Terms of Use (“Terms”) govern your access to and use of poacaregiver.com and the products, content, courses, and services offered on it (collectively, the “Services”), provided by POA Caregiver LLC (“POA Caregiver™,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Education, not legal advice

All handbooks, the POA Caregiver Program and its Workbook, Premium Resources, worksheets, tools, private consultations, and other content are provided for general educational purposes only. They are not legal, financial, medical, or tax advice, and they do not create an attorney–client, fiduciary, or other professional relationship. Power of Attorney requirements vary by state and change over time. For advice about your specific situation, consult a licensed attorney or other qualified professional in your jurisdiction.

State Handbooks and state guides describe a specific state’s law as of the date shown on them. The Program, Premium Resources, and other national materials are general education and organizational tools that are not specific to any one state.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services.

Purchases, pricing & payment

• Prices are shown in U.S. dollars and may change at any time before purchase.
• Payments are processed by our third-party processor, Stripe. We do not collect or store full payment card numbers. Your purchase is also subject to Stripe’s terms and privacy policy.
• You agree to provide accurate, complete purchase and contact information.

Digital products & license

When you purchase or access a digital product (such as a Handbook PDF, the Program and its Workbook, or a Premium Resource), we grant you a limited, non-exclusive, non-transferable, revocable license to access and use it for your own personal, non-commercial use. You may not copy, share, resell, sublicense, distribute, or publicly post the materials, or remove any copyright or proprietary notices. Worksheets may be printed for your personal caregiving use.

Digital products are delivered electronically: a download link is emailed after purchase and your purchases remain available from My Resources when you sign in with your checkout email. The Program Workbook is included with the POA Caregiver Program and is not sold separately; customers who previously purchased it keep their access.

Premium Resources

Premium Resources are practical organizational tools (checklists, logs, trackers, and worksheets) that you can complete on screen or print. They support organization, documentation, and recordkeeping only. Financial tools are not accounting, tax, investment, or legal advice; health-related tools are not medical advice.

Private POA & Caregiver Consultations

A Private POA & Caregiver Consultation is a 30- or 60-minute conversation by phone or Zoom, scheduled and paid through our scheduling provider. “Consultation” here means practical education, organizational support, and resource navigation about the Power of Attorney and caregiving role. Consultations are not individualized legal, medical, tax, financial, or other regulated professional advice; we do not interpret legal documents or determine your legal authority, and a consultation does not create an attorney–client or other professional relationship.

The Program & certification

The POA Caregiver Program certifies completion of training and a signed ethics commitment. It is not a government license or professional certification and does not authorize you to practice law, finance, accounting, or medicine. Program content, the credential name, and any continuing-education details may change.

Intellectual property

All content and materials on the Services are owned by POA Caregiver™ or its licensors and are protected by copyright and other laws. Except for the limited license above, no rights are granted to you.

Acceptable use

You agree not to misuse the Services, including by attempting to disrupt them, access them without authorization, infringe others’ rights, or use the materials in violation of these Terms or applicable law.

Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that the content reflects the most current law.

Limitation of liability

To the fullest extent permitted by law, POA Caregiver™ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Services or reliance on the content. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the product or service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless POA Caregiver™ from claims arising out of your misuse of the Services or violation of these Terms.

Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted. Your continued use of the Services means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction of those courts.
