These Terms of Use (“Terms”) govern your access to and use of poacaregiver.com and the products, content, courses, and services offered on it (collectively, the “Services”), provided by POA Caregiver LLC (“POA Caregiver™,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
All handbooks, the POA Caregiver Program, worksheets, tools, consultations, and other content are provided for general educational purposes only. They are not legal, financial, medical, or tax advice, and they do not create an attorney–client, fiduciary, or other professional relationship. Power of Attorney requirements vary by state and change over time. For advice about your specific situation, consult a licensed attorney or other qualified professional in your jurisdiction.
You must be at least 18 years old and able to form a binding contract to use the Services.
When you purchase or access a digital product (such as a Handbook PDF or the Program), we grant you a limited, non-exclusive, non-transferable, revocable license to access and use it for your own personal, non-commercial use. You may not copy, share, resell, sublicense, distribute, or publicly post the materials, or remove any copyright or proprietary notices. Worksheets may be printed for your personal caregiving use.
The POA Caregiver Program certifies completion of training and a signed ethics commitment. It is not a government license or professional certification and does not authorize you to practice law, finance, accounting, or medicine. Program content, the credential name, and any continuing-education details may change.
All content and materials on the Services are owned by POA Caregiver™ or its licensors and are protected by copyright and other laws. Except for the limited license above, no rights are granted to you.
You agree not to misuse the Services, including by attempting to disrupt them, access them without authorization, infringe others’ rights, or use the materials in violation of these Terms or applicable law.
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that the content reflects the most current law.
To the fullest extent permitted by law, POA Caregiver™ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Services or reliance on the content. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the product or service giving rise to the claim.
You agree to indemnify and hold harmless POA Caregiver™ from claims arising out of your misuse of the Services or violation of these Terms.
We may update these Terms from time to time. Changes are effective when posted. Your continued use of the Services means you accept the updated Terms.
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction of those courts.
